Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Homes AVM LLC, a company registered in the Hashemite Kingdom of Jordan (registration no. 546522165432) (“Homes AVM,” “we,” “us” or “our”). They govern your use of homesavm.com, the Homes AVM portal, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you use the Service for a company, you agree on its behalf and confirm you have authority to do so.

1. The Service

Homes AVM helps mortgage loan officers and similar professionals stay in touch with their clients. The Service includes personalized home reports, client import and management, monthly Home Digest emails sent in your name, an engagement dashboard, and done-for-you services such as website setup. Features may change over time as we improve the Service.

2. Accounts

You must be at least 18 years old and provide accurate, complete information when you sign up. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at info@homesavm.com if you suspect unauthorized access.

3. Plans, free trial and billing

• Homes AVM offers two plans: Starter at $25 per month (500 campaign emails per calendar month, 1 website) and Pro at $40 per month (1,000 campaign emails per calendar month, 3 websites). Monthly email allowances reset on the first day of each month in UTC, including for yearly subscriptions. Pending campaigns reserve their recipient count; cancelled or failed campaigns release that reservation. Yearly billing is 30% off: $210 per year for Starter and $336 per year for Pro. Prices are in US dollars, and sales tax or VAT is added at checkout where required.
• New accounts start with a 5-day free trial. A valid payment method is required to start it, and you are not charged during the trial. During the trial, campaign sending is limited to 100 emails.
• If you cancel before the trial ends, you will not be charged. Otherwise your subscription begins automatically when the trial ends and renews at the start of each billing period (monthly or yearly, as you chose) until you cancel.
• Subscriptions are sold and billed by Paddle, our reseller and merchant of record. Your purchase is also subject to Paddle’s buyer terms, and Paddle handles payment processing, taxes, invoices and receipts. Charges on your card statement come from Paddle.
• You can cancel at any time from your account settings. When you cancel after a payment, your subscription stops renewing right away and you keep access until the end of the period you already paid for. You will not be charged again.
• You may request a full refund of any payment within 14 days of that payment, as described in our Refund Policy at homesavm.com/refund-policy. When a payment is refunded, the subscription it paid for ends.
• If a payment fails, access to the portal is paused until you update your payment method or pay the outstanding amount.
• We may change prices with at least 30 days’ notice. New prices apply from your next billing period after the notice.
• Team and company pricing is agreed separately; book a call through our website.

4. Acceptable use

You agree not to use the Service to:

• Send spam, or email anyone who has not agreed to hear from you where consent is required.
• Upload data you do not have the right to use, or data obtained by scraping, purchase of lists, or other means that violate law or third-party terms.
• Send misleading, deceptive, discriminatory or unlawful content, including content that violates fair lending or fair housing laws.
• Impersonate any person or business, or misrepresent your license status.
• Interfere with, probe, overload or attempt to gain unauthorized access to the Service or other accounts.
• Copy, resell, reverse engineer or build a competing product from the Service.

We may suspend sending or access if we reasonably believe your use violates these Terms, harms email deliverability, or exposes Homeowners, other customers or us to risk.

5. Your compliance responsibilities

You are solely responsible for your use of the Service and for complying with all laws and regulations that apply to your business and communications, including, as applicable, the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Real Estate Settlement Procedures Act (RESPA), state licensing and advertising rules, and privacy laws.

You represent that you have a lawful basis, and any consent required by law, to upload each client’s information and to contact them through the Service, including by email, phone or text from links in their report. You are responsible for the accuracy of your license details, disclosures and branding. We provide tools such as unsubscribe handling and standard NMLS and Equal Housing disclosures, but these do not replace your own compliance review.

6. Estimates are not appraisals

Home values, ranges, equity figures, nearby sales, rate information and payment comparisons in the Service are automated estimates based on public records, market data and the information you provide. They are for general information only. They are not appraisals, are not loan offers or commitments to lend, and may be inaccurate or out of date. They should not be relied on for any lending, purchase, sale or financial decision.

7. Your content and license to us

You keep ownership of the content and data you provide, including client lists, branding, photos and text (“Customer Content”). You grant us a non-exclusive, worldwide, royalty-free license to host, copy, process, display and transmit Customer Content only as needed to provide, secure and improve the Service and as described in our Privacy Policy. You confirm you have the rights needed to grant this license, including rights to any logos, photos and fonts you upload.

We process Homeowner data on your behalf as described in our Privacy Policy, and we do not sell it or use it to market to Homeowners for ourselves or others.

8. Our intellectual property

The Service, including its software, design, report formats, templates and the Homes AVM name and logo, is owned by us or our licensors and protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your business during your subscription. If you send us feedback or suggestions, we may use them without obligation to you.

9. Done-for-you services

Where we prepare reports, organize client imports, send campaigns, or build a website for you, we do so on a reasonable-efforts basis and within typical timeframes we may share, which are estimates and not guarantees. You are responsible for reviewing work we prepare on your behalf, including website copy and disclosures, before and after it goes live.

Websites are built with search engine and AI-search best practices in mind, but we do not guarantee any search ranking, traffic, leads, or that any search engine or AI assistant will display, cite or recommend you. You are responsible for your domain registration and any third-party accounts connected to your site.

10. Third-party services

The Service relies on and may link to third-party services, such as Paddle for payments, Calendly for scheduling, email delivery providers, social networks and data sources. Your use of those services is governed by their own terms. We are not responsible for third-party services or their availability, and they may change or stop working with the Service.

11. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or if we are required to by law, and we will try to give notice where reasonable. On termination, your right to use the Service ends. You may request an export of your client data within 30 days after termination; after that we may delete it as described in our Privacy Policy. Sections that by their nature should survive termination will survive, including sections 5 through 8 and 12 through 15.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ESTIMATES WILL BE ACCURATE, OR THAT EMAILS WILL BE DELIVERED OR OPENED.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER HOMES AVM NOR ITS OWNERS, EMPLOYEES OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnity

You will defend, indemnify and hold harmless Homes AVM and its owners, employees and suppliers from any claims, damages, losses and expenses, including reasonable attorneys’ fees, arising from your Customer Content, your communications with clients, your breach of these Terms, or your violation of any law or third-party right, including TCPA, CAN-SPAM, RESPA, licensing and privacy laws.

15. Governing law and disputes

These Terms are governed by the laws of the Hashemite Kingdom of Jordan, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the competent courts of Amman, Jordan, and you and we consent to their jurisdiction. Nothing in this section removes any rights you have under mandatory consumer protection laws where you live.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and notify you by email or in the portal before the changes take effect. Continuing to use the Service after that means you accept the updated Terms.

17. General

These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
